Drake Sued for Illegal Sample

The Estate of Jimmy Smith wants their cut of "Pound Cake."

Your man Drake truly can’t catch a break out here. The estate of legendary jazz musician Jimmy Smith is now going after the rapper that calls himself “Champagne Papi” for illegal usage of the Jimmy Smith spoken word piece “Jimmy’s Rap,” on his song “Pound Cake/Paris Morton Music 2.” A rapper being sued for sampling a rap? Go figure.

In the liner notes of Nothing Was The Same, it states that the sample was cleared by Cash Money for Drake’s usage, but Smith’s estate quickly shut that idea down, saying they were never contacted for permission to use the joint in question. Now, they have hit Drake and Cash Money with a lawsuit for more than $300,000.
